1. Designated agent

NLB Merch LLC has designated the following agent to receive notifications of claimed copyright infringement under 17 U.S.C. § 512(c)(2):

2. How to report infringement

If you believe material on this site infringes a copyright you own or are authorized to act for, send a written notice to the agent above. To be effective under 17 U.S.C. § 512(c)(3), your notice must include all six of the following:

(1) A physical or electronic signature of the copyright owner or a person authorized to act on their behalf. (2) Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered by a single notice. (3) Identification of the material claimed to be infringing and enough information for us to locate it — a direct URL is best. (4) Your contact information: address, telephone number, and email. (5) A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law. (6) A statement that the information in the notice is accurate, and — under penalty of perjury — that you are authorized to act on behalf of the owner.

We act on complete notices promptly, usually within one business day. A notice that is missing required elements may not be actionable; if that happens we will tell you what is missing rather than simply ignoring it.

Before sending a notice, please consider whether the use is a fair use. Under 17 U.S.C. § 512(f), anyone who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorneys’ fees.

3. What happens after a notice

We remove or disable access to the identified material and notify the account holder who posted it, including a copy of the notice. Removal is not a finding that you did anything wrong — it is the process the statute sets out, and you have a right to respond.

4. Counter-notification

If your material was removed by mistake or misidentification, you may send a counter-notification to dmca@aifilmmakerindex.com. Under 17 U.S.C. § 512(g)(3) it must include: your physical or electronic signature; identification of the material and the location where it appeared before removal; a statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification; and your name, address, and telephone number, together with a statement that you consent to the jurisdiction of the Federal District Court for the district where you live (or, if outside the United States, any district in which we may be found) and that you will accept service of process from the person who sent the original notice.

We forward valid counter-notifications to the complaining party. Unless they notify us that they have filed an action seeking a court order to restrain the activity, we restore the material between 10 and 14 business days after we receive your counter-notification.

5. Repeat infringer policy

We terminate, in appropriate circumstances, the accounts of repeat infringers. This is a condition of using the Service and we mean it.

A "repeat infringer" is not limited to someone a court has found liable, and not limited to someone who acted deliberately — copyright infringement does not require intent. In practice, an account that is the subject of three substantiated infringement notices within any twelve month period will be terminated. We may terminate sooner where the conduct is flagrant, and we weigh the volume of complaints, the time between them, whether the notices are complete, and whether the account holder appears to be uploading material they know is not theirs.

We keep a record of every notice we receive and the action we took. Terminated accounts lose their listing without refund of any subscription fee for the remainder of the term.

6. Embedded video

Most video on this site is not hosted by us. It is embedded from YouTube, Vimeo, Loom, Wistia, Streamable, or Dailymotion and plays from that platform’s servers. If you want a video taken down at the source, the fastest route is a notice to that platform, which controls the file. You may also send us a notice and we will remove the embed from the listing.

By adding a video or image to a listing, you represent that you own it or have the rights to display it here, and that doing so does not infringe anyone else’s rights.
